DEAR USER, at GRUPO MASXMX we are aware of the importance of properly protecting our Users' personal data. In accordance with the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), GRUPO MASXMX (hereinafter "11:11 Fitness"), with address at Avenida Paseo de los Leones S/N, interior 216, Colonia Puerta de Hierro, Monterrey, Nuevo León, CP 64349, as data controller, makes available to you the following Privacy Notice so that you may have full knowledge of how your personal data will be processed, and to facilitate the exercise of your rights under the LFPDPPP.
1. Personal Data Collected
The personal data we collect from our Users and Guests includes: full name, address, contact and/or emergency contact phone numbers, CURP (national ID number), gender, email address, occupation, place of work, and date of birth. Additionally, if the User chooses to contract services with 11:11 Fitness, information related to the bank account, credit card, or debit card provided will be collected, along with RFC (tax ID), fingerprint, images and video of users entering the facilities, and a photograph for the purposes set out in the following section.
For minors, the same information described above will be requested from their parents or legal guardians.
All of the personal data listed above is essential for 11:11 Fitness to provide its contracted services. If you do not accept the use of your data for the purposes established in section 2, 11:11 Fitness will be unable to provide its services. In such case, revoking consent or exercising cancellation or objection rights will result in the termination of any service contract with 11:11 Fitness, without liability to 11:11 Fitness.
We will process personal data and official identification documents of minors provided by parents and/or guardians, always with their consent. Parents and/or guardians may at any time exercise ARCO rights or revoke consent for the processing of minors' personal data, provided they can demonstrate their capacity as parent or legal guardian.
To ensure that physical conditioning activities performed at 11:11 Fitness facilities are appropriate for your health condition, general medical information may be collected based on each User's individual circumstances, along with a clinical diagnostic letter if required.
2. Purposes of Processing
Your personal data is used (processed) for the following purposes: (i) execution of service contracts, (ii) physical and/or electronic registration identification and verification; (iii) contact through various means including phone, chat (WhatsApp), social media and others; (iv) identification upon entry to facilities; (v) billing for contracted services; (vi) proper handling of any emergency situation requiring health information held by 11:11 Fitness; (vii) recommendations regarding appropriate physical conditioning based on your health status; and (viii) use of the mobile app and other contracted digital services.
Your personal data will also be used for commercial and promotional purposes: (i) sending information about our products or services, (ii) conducting service quality surveys; (iii) delivering offers and promotions from 11:11 Fitness; and (iv) promoting sweepstakes, events, contests and trivia organized by 11:11 Fitness.
If you do not wish your personal data to be used for the commercial and promotional purposes described above, you may contact us at any time to limit such processing via email at lucas@onceoncefitness.com or in person at our offices at Avenida Paseo de los Leones S/N, interior 216, Colonia Puerta de Hierro, Monterrey, Nuevo León.
The user will provide public contact information of a third party who, in case of emergency, may be contacted for timely attention to any incident within the facilities. The user declares under oath that they have instructed and received authorization from this third party to provide their information, and that this third party consents to 11:11 Fitness processing their data for the purposes described above.
3. Security Measures
To ensure proper protection of your personal data and full compliance with the obligations established by the LFPDPPP, 11:11 Fitness has implemented the necessary and sufficient administrative, technical, and physical security measures for the proper protection of your data.
4. Exercise of ARCO Rights
You may exercise your rights of Access, Rectification, Cancellation, and/or Objection to the processing of your personal data at any time by submitting a written request to our offices at Av. Paseo de los Leones S/N, interior 216, Colonia Puerta de Hierro, Monterrey, Nuevo León, México, and/or to lucas@onceoncefitness.com. Your request must include at least: (a) your name and address or other contact method for our response; (b) documents proving your identity or legal representation; (c) a clear and precise description of the personal data for which you are requesting an ARCO right; (d) explicit statement of the right (access, rectification, or objection) you wish to exercise; (e) membership number and copy of your contract for system identification; (f) any other element that may help locate your personal data.
5. Data Transfers
Under no circumstances will 11:11 Fitness transfer Users' personal data to third parties without prior consent from the data subjects, except in cases requiring emergency medical assistance, in which case the sensitive personal data held by 11:11 Fitness may be provided to emergency medical service providers and/or designated personnel.
6. Changes to this Privacy Notice
11:11 Fitness reserves the right to change or expand this Privacy Notice at any time. Any changes will be communicated through our website at https://www.onceoncefitness.com.
7. Consent to Processing
By acknowledging this document, I consent to the processing of my personal data for the purposes communicated to me by 11:11 Fitness through this Privacy Notice.
8. Return Policy
11:11 Fitness does not process refunds for online purchases or point-of-sale transactions.
