I. Purpose

The purpose of these TERMS AND CONDITIONS is to regulate access to and use of the WEBSITE, understood as any type of content, product, or service available to the general public within the domain www.onceoncefitness.com.

The OWNER reserves the right to modify at any time and without prior notice the presentation, content, functionality, products, services, and configuration of the WEBSITE. The USER acknowledges and accepts that GRUPO MASXMX may at any time interrupt, disable, or cancel any elements of the WEBSITE or access to them.

In addition to internet connection costs under the USER's telecommunications contracts, some content or services on www.onceoncefitness.com or offered by third parties through the WEBSITE may require prior subscription. In such cases, the applicable general or specific conditions will be clearly stated and made available to the USER.

Access to certain content and services on the WEBSITE may require prior user registration or subscription.

The WEBSITE is directed exclusively at persons of legal age (18 years or older). GRUPO MASXMX disclaims any liability for non-compliance with this requirement.

The WEBSITE is primarily directed at users residing in Mexico. GRUPO MASXMX does not guarantee that the WEBSITE complies with the laws of other countries. Users residing outside Mexico access the WEBSITE at their own risk and must ensure their use complies with applicable local law.

The OWNER may administer or manage the WEBSITE directly or through a third party, which does not affect these TERMS AND CONDITIONS in any way.

II. The User

Accessing or using the WEBSITE, as well as resources enabling interaction between USERS or between the USER and the OWNER (such as posting or commenting), grants the status of WEBSITE USER and subjects the user to these TERMS AND CONDITIONS and any subsequent modifications. Acceptance is implied from the moment of access to the WEBSITE. Users are advised to review updates to these TERMS AND CONDITIONS.

GRUPO MASXMX reserves the right to remove any comments or contributions that violate the law, dignity of persons, are discriminatory, infringe third-party rights or public order, or are otherwise deemed unsuitable for publication.

GRUPO MASXMX is not responsible for opinions expressed by USERS through comments or posts.

Mere access to the WEBSITE does not establish any relationship between the OWNER and the USER.

As the WEBSITE is directed exclusively at adults, the USER represents that they are of legal age and have the legal capacity to be bound by these TERMS AND CONDITIONS.

III. Access and Navigation

The OWNER does not guarantee the continuity or availability of content, products, or services offered through the WEBSITE. However, the OWNER will take reasonable steps to maintain proper WEBSITE functioning, without this implying any liability on the part of GRUPO MASXMX.

GRUPO MASXMX is not responsible for and does not guarantee that content or software accessible through the WEBSITE is free from errors, malware, or that it will not cause software or hardware damage to the USER's device.

The OWNER is not responsible for damages caused by improper use of the WEBSITE. Under no circumstances will GRUPO MASXMX be liable for any losses, damages, or harm of any kind arising solely from access to or use of the WEBSITE.

In accordance with the Federal Law on Protection of Personal Data Held by Private Parties, the OWNER agrees to adopt necessary measures to ensure the privacy of collected personal data, guaranteeing its security and preventing alteration, loss, or unauthorized processing.

VI. Intellectual and Industrial Property Policy

GRUPO MASXMX, on its own behalf or as an assignee, holds all intellectual and industrial property rights to the WEBSITE, including the source code, images, audio or video files, logos, trademarks, color combinations, structures, designs, and other distinguishing elements. These are protected by Mexican intellectual and industrial property law and applicable international treaties. The USER agrees to respect the OWNER's intellectual and industrial property rights. The USER may view, print, copy, or store WEBSITE elements exclusively for strictly personal use.

The USER may not delete, alter, or manipulate any element, file, or content of the WEBSITE, and must not attempt to breach the security, files, or databases protected by restricted access through username and password or for which the USER lacks viewing, editing, or manipulation permissions.

VII. Applicable Law and Jurisdiction

GRUPO MASXMX reserves the right to bring civil or criminal actions it deems necessary for improper use of the WEBSITE, its content, products, or services, or for breach of these TERMS AND CONDITIONS.

The relationship between the USER and GRUPO MASXMX is governed by the laws in force in Mexico, specifically in Nuevo León. Any dispute arising from the interpretation and/or application of these TERMS AND CONDITIONS will be submitted to the jurisdiction of the ordinary courts corresponding to the state referenced herein.
